Our community has grown significantly this year, so we’re updating our Terms of Service, Payments Terms of Service, and Privacy Policy (collectively, “Terms”). The changes will go into effect for all existing users on December 7, 2016. When you use our site on or after that day, we’ll ask you to agree to the new Terms. We have also updated our Guest Refund Policy and Host Guarantee Terms and Conditions, which will go into effect for existing users on December 7, 2016
You can review the new Terms by clicking here. We’ve also put up information to explain these changes in more detail on our Terms of Service Event page. Both the old and new versions of the Terms can be found at the Terms of Service, Payments Terms of Service, Privacy Policy, Guest Refund Policy, and Host Guarantee Terms and Conditions tabs through January 7, 2017. You should review these Terms in full yourself.
In particular, we’re making some operational changes for our business in China (which for purposes of the Terms, excludes Hong Kong, Macau and Taiwan) (“China”). Beginning December 7, 2016, we will operate our business in China through Airbnb Internet (Beijing) Co., Ltd. (“Airbnb China”). In particular, if you have existing listing(s) in China, some of your information will be transferred to, stored, used and processed by Airbnb China from December 7, 2016. You can learn more about what all of this means for you by clicking here.
After December 7, 2016, if any of your personal information would be transferred to, stored, used or processed by Airbnb China as a result of any action that you propose to take, you will be notified of this before any such transfer, storage, use or processing is undertaken.
Like hotels and other businesses operating in China, Airbnb China has to comply with local laws and regulations, including privacy and information disclosure laws, and may be required by Chinese government agencies to disclose information held by it, such as host, guest, and listing information relating to stays in China. If you would like to continue using Airbnb but do not wish to have your information transferred to, stored, used or processed by Airbnb China, you should remove any existing listing(s) you have in China, from your Airbnb account.
Finally, our records show that you do not reside in China. If you reside in China, please update the ‘Where You Live’ section in your profile and the ‘Country of Residence’ section in your account settings and refer to this page for relevant information on the changes to the Terms specific to users who reside in China.
