    Hi,

    I'm refering to your letter 8/5, where you explain about my Council Tax-arrears.

    I'm from Norway, and I've been 'messed with' at the CAB, so I haven't known my rights.

    I was really underpaid, in 2007 and 2008, because I started in a new job, in the packaging business, and did my work, much more thorow, than agency-staff who also did the same job.
    (I found out later, when I was given the job, of revieving the work, that the agency-staff had done).

    It took me some time to learn about the packaging-methods, materials and packaging-machines, so I think I must have gotten less than the UK minimum-wage, for 2007 and 2008.
    (I still have the invoices to show this).

    But now I guess I really should have gotten Counil Tax-benefit, for 2007 and 2008.
    Is it to late to apply for this now?
    (I thought I could ask, since we're already corresponding about this).

    Hi,

    I'm referring to your letter, from 9/3, which I received earlier this week.
    It says that £592.21 of last years Council Tax, is subject to Court Proceedings.
    I wondering a bit what you mean with this.

    Since I've been unemployed, during the recession, unfortunately.
    (Even if I've tried to start an e-business, and more).
    And I've had Council Tax Benefit, (as far as I've understood), since 2008.

    So how can there be any Court Proceedings, in connection with last years Council Tax then?
    (It's always said amount due: £0.00, since 2008, on the Council Tax-bills, as far as I can remember, at least).

    Could you please explain more about this to me?

    Hi,

    I'm refering to the letter from Mr. Anthony Nugent, from 30/3, with ref: 10055749.
    He writes that my Landlord has proven I'm in more than eight weeks arrears.

    But, the Landlord haven't given me a contract, so I think it isn't clear, what my rent is, and therefore not clear how much the arrears are.

    (I've capped the Housing Benefit with around £30 a month since I have to do electricity work, on the bath etc., myself, since the Landlord don't do repairs, or at least are very slow with doing them, and ignore my complaints.

    I've also had to buy a new washing machine etc., since the Landlord didn't fix the old one, which was here when I moved in, when it broke down.
    But I haven't capped the Housing Benefit with as much as eight weeks rent, more like three or four weeks rent, for 2010, I'd say.

    So I think these figures must be inacurate.
    Especially since we don't really know what we are discussing here.
    The Landlord haven't given me a contract, (for some reason), since 2005, so I don't really exactly know what the rent is, I only pay what I can afford).

    I wanted to complain on that the Council accepts the Landlord, (Imperial Properties/T.J. Thomas), figures, even if there are no contract which can document that these figures are right.
    So I think it's uneccesarry use of power, from the Council, to safe-guard against me, I think, since I haven't been irresponsible, or anything, I pay all my other bills on time, and according to a budget I'm on, in co-operation, with the CCCS.

    But the problem is that the Landlord don't do repairs, and don't give me a contract, for some reason.
    So to blame this on me needing to be safe-guarded against, is like a Kafka-process, I think, that old Stalin would have been proud of.

    I hope you can freeze the payments of the Council Tax, to Imperial Properties, untill I have been given a contract, and it's settled how much I really owe in arrears.
    I have another dispute with them as well, (which I've updated the Council about), and that's about the bins.

    They are in the bin-store of the restaurant Lady of Mann, and are only accessable when the restaurant is open, and one have to walk passed a lot of restaurant-guests, to throw ones litter, because if one put it by the gate, of the restaurant, then the Council don't like that, but send complaints to the Landlord, who complains to the tenants.

    The Landlord claims the bins are accessable 24 hours, but they aren't at all, only when the restaurant-staff has open the gate for the beer-garden there.
    Also, the Landlord didn't fix the boiler, for two years almost, in 2007 and 2008, I think it was.

    So I think this should be like a compensation-case, because they must have done this to punish me, or something.
    But I really think the Housing Benefit should be sent to me.

    And then I can put it on a bank-account, untill I get a contract.

    And untill the Landlord and I have agreed on how much the arrears are.
    I don't think I really have any arrears, since the Landlord have 'messed' with me, a lot, then I should have compensation, which should cancel out the arrears, at least.

    Hope you agree with me on this!

    Hi,

    I want to please appeal against the decition, in Mr. A. Knight's letter, from 16/3, where he writes that he wants to safe-guard my Housing Benefit, and send it to my Landlord directly.

    But I consider myself to be a responsible person, and I think it's unfair that I should be patronised by Mr. Knight, in this way.

    The arrears are due to that the Housing Benefit is lower than the Landlord operates with.

    Also, the Landlord aren't fixing stuff which gets broken, so I've done things like electricity work, and buying a new washing-machine from Argos, which I've deducted from the rent.

    (A disrepair-inspector have been here from the Council, but I haven't gotten anything in writing back, so I also send a copy of this e-mail to the Council Leader as a reminder of this, which I've sent about to the top of the Council before).

    I think it's unfair that my reputation and name should be distroyed due to that the Landlord and the Council values the rent diffently, and then blames the arrears on me.

    The Housing Benefit, was quite resently increased from £330 to £390 a month, but this has only been for a few months.

    So the arrears that the Council and the Landlord blames from me mostly due to that the Housing Benefit was lower, in 2010.
    So this process is a Kafka-process and a hoax, I'd say.

    I admit to have capped of the Housing Benefit a bit, and only paid the Landlord £300 each four weeks, but that's due to that the Landlord don't do repairs, when things get broken in the bath-room, etc., so I have to do this myself.

    The Landlord also lie about the garbage-throwing arrangement, (the bins are in the bin-store of Lady of Mann-restaurant, and says that the bins are accessable 24/7.
    While they are only accessable when the Dale St. restaurant it open.

    And one have to walk passed a group of people eating and drinking in the beer-garden, to throw ones litter.
    So I don't think this Landlord deserves to get the whole rent, so I've capped it a bit, to punish them, for not doing repairs, etc.

    Now, I'm aware of the Council disrepair-inspector, but I haven't been earlier.
    But to patronise and safe-guard against me like this, I think is very unfair, because I think it could be bad for my reputation.

    And I've been unemployed and haven't had much founds, so it hasn't been fun for me eighter.
    I think it's unfair that I should be punished here.
    Here it is a case where the Landlord don't fullfill their obligations, (which I've reported to the Council).

    And I haven't even got it in writing, what the rent really is.
    Since I haven't got a contract.
    So to even speak of arrears, is a bit silly, I think, when it isn't certain what the rent is.

    So this safe-guarding is a joke in my eyes, and I hope the appeal-commity will please over-turn this mistake from the Council.
